Audiovisual Material

Any public performance of Audio Visual material, regardless of audience, must have copyright clearance.

Just as the university negotiates with Access Copyright for permission to photocopy textual works, UNB also maintains educational public performance rights agreements with two film collectives Audio Ciné Films and Criterion Pictures to show videos in an educational environment. Please see UNB Libraries Film and Video Collection for a list of films available.

Copyright regulations of audio visual material are similar to those that apply for creators and users of print material. As soon as you have recorded and posted a work (i.e. lecture, presentation, etc.) anyone wishing to incorporate your material for their use must acquire permission from you. Although copyright protection is automatic, you may consider registering you material if you feel there is potential of an infringement you will want to pursue legally. Separate from UNB license agreements, the Copyright Act does provide an educational exception for performing news programmes. Educational institutions or persons acting under its authority are permitted to:

"(a) make...a SINGLE copy of a news program or a news commentary program, EXCLUDING DOCUMENTARIES, for the purposes of performing the copy for the students of the educational institution for educational or training purposes; and (b) perform the copy in public, at any time or times WITHIN ONE YEAR after making the copy..."
